Welcome to Basket Shield. These Terms of Service ("Terms") govern your use of our software application (the "Service"), operated by Passie Apps. By accessing or using the Service, you agree to be bound by these Terms.
1. Use of the Service
You may use Basket Shield only for lawful purposes. You are responsible for maintaining the security of your account and for any activities or actions under your account. You agree not to misuse the Service or attempt to reverse engineer its underlying trademark scanning algorithms.
2. Subscriptions and Billing
Parts of the Service are offered on a subscription basis (Starter and Pro tiers). You will be billed in advance on a recurring, monthly basis via Paddle. All fees are non-refundable except as expressly described in our Refund Policy.
3. Disclaimer of Legal Advice
Basket Shield provides automated scanning for potential trademarked keywords based on a curated database. This tool does not constitute legal advice. We are not lawyers. While we strive for accuracy, we cannot guarantee that our database is exhaustive or perfectly up-to-date. You are ultimately responsible for ensuring your listings comply with Etsy's policies and applicable trademark laws.
4. Limitation of Liability
To the maximum extent permitted by law, Passie Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of Basket Shield, including but not limited to the suspension of your Etsy shop.
5. Third-Party APIs
Basket Shield relies on the Etsy API. We reserve the right to modify or discontinue features if changes to the third-party API restrict our ability to access necessary data.
